1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and EA Services Group LLC ("Company", "we", "us", or "our"), the operator of HospitaLink at hospitlink.com ("Platform"). By creating an account, posting a job, or applying to a position, you acknowledge that you have read, understood, and agree to these Terms.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

2. Eligibility

To use HospitaLink, you must:

• Be at least 18 years of age
• Have the legal authority to enter into binding contracts
• Not be prohibited from using our services under applicable law
• Provide accurate, current, and complete information during registration

By using the Platform, you represent and warrant that you meet all eligibility requirements.

3. Employer Accounts and Job Postings

Employers who register on HospitaLink agree to the following:

• All information provided about your business, venue, and job openings must be accurate, truthful, and not misleading
• Job listings must be for legitimate, legal employment opportunities in the hospitality industry in Florida
• You are solely responsible for the content of your job postings
• Job listings may not contain discriminatory language or requirements that violate federal, state, or local employment laws
• You may not post the same position multiple times simultaneously to gain unfair visibility
• HospitaLink reserves the right to remove any job posting at its sole discretion without notice or refund

4. Candidate Accounts and Applications

Job seekers who register on HospitaLink agree to:

• Provide truthful and accurate information in their profiles, including work experience and qualifications
• Only apply to positions for which they are genuinely interested and qualified
• Not misrepresent their skills, experience, or identity to employers
• Maintain professional conduct in all communications through the platform
• Not use the platform for any commercial purpose other than seeking employment

5. Payments and Fees

Job posting fees are displayed at the time of purchase and are subject to change at our discretion. By submitting payment, you agree that:

• All fees are charged in US Dollars (USD)
• Payments are processed securely by Stripe and are subject to Stripe's Terms of Service
• Job listings are activated upon successful payment confirmation
• All sales are final. No refunds will be issued for purchased job listings, including listings that are removed for policy violations
• HospitaLink is not responsible for payment processing errors caused by your financial institution
• Promotional pricing (including free listings) may be changed or discontinued at any time without notice

6. Prohibited Conduct

You agree NOT to use HospitaLink to:

• Post fraudulent, misleading, or deceptive job listings or candidate profiles
• Harvest, scrape, or collect user data without authorization
• Send unsolicited commercial messages (spam) to other users
• Impersonate any person, business, or entity
• Upload malicious code, viruses, or any software intended to damage or disrupt our systems
• Circumvent any security or access control measures
• Engage in any activity that violates applicable federal, state, or local law
• Use the platform in any way that could harm, disable, or impair the platform or other users' experience

Violation of these prohibitions may result in immediate account termination without notice or refund.

7. Intellectual Property

All content on HospitaLink — including but not limited to the logo, design, text, graphics, software, and code — is the exclusive property of EA Services Group LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

By posting content on our platform (job listings, profiles, etc.), you grant EA Services Group LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating and promoting the platform.

8. Disclaimer of Warranties

HospitaLink is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or secure at all times
• Job listings will result in successful hires
• Candidate profiles accurately reflect the qualifications of applicants
• Any particular job or candidate will meet your specific requirements

EA Services Group LLC expressly disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by applicable law, EA Services Group LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the platform
• Any hiring decisions made based on information obtained through HospitaLink
• Unauthorized access to or alteration of your data
• Any third-party content or conduct on the platform
• Any bugs, viruses, or errors in the platform

In no event shall our total liability exceed the amount paid by you to HospitaLink in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless EA Services Group LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit, post, or transmit through the platform.

11. Third-Party Services

HospitaLink integrates with third-party services including Stripe, Google Analytics, Resend, Supabase, and Tawk.to. Your use of these services is subject to their respective terms and privacy policies. EA Services Group LLC is not responsible for the practices or content of any third-party service.

12. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform immediately ceases. We are not liable to you or any third party for any termination of your account. You may delete your account at any time by contacting us at easervicesg@gmail.com.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of HospitaLink shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of such courts.

Before initiating any legal action, you agree to attempt to resolve any dispute informally by contacting us at easervicesg@gmail.com. We will attempt to resolve the dispute within 30 days.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EA Services Group LLC regarding your use of HospitaLink and supersede all prior agreements and understandings.
